These terms govern your use of gainifyapps.com and the apps published by Gainify. By downloading, installing or using an app, you agree to these terms.
Licence
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the apps for your own lawful purposes, subject to these terms and to the rules of the store you downloaded them from (Apple App Store or Shopify App Store).
Subscriptions and auto-renewal (iOS)
Some apps offer auto-renewing subscriptions, sold through the Apple App Store and managed with RevenueCat. Payment is charged to your App Store account at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours prior to the end of the current period, at the price shown in the app. You manage and cancel subscriptions in your App Store account settings, not within the app.
Any unused portion of a free trial, where offered, is forfeited when you purchase a subscription.
Some apps also offer a one-time “lifetime” unlock. That is a single non-renewing purchase, not a subscription: it does not auto-renew and there is nothing to cancel.
EU right of withdrawal: where digital content or services begin with your prior express consent, you acknowledge you may lose the 14-day right of withdrawal once performance has begun, to the extent permitted by law. Statutory consumer rights are not affected.
Apple App Store — additional terms
These additional terms apply to apps you download from the Apple App Store, and exist because Apple requires them:
- This agreement is concluded between you and Gainify only, not with Apple. Apple is not responsible for the app or its content.
- The licence granted to you is a non-transferable licence to use the app on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
- Gainify — not Apple — is solely responsible for providing maintenance and support for the app. Apple has no obligation to furnish any maintenance or support services.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the app.
- Gainify — not Apple — is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to any legal or regulatory requirement, and claims arising under consumer-protection or similar legislation.
- In the event of a third-party claim that the app or your use of it infringes that third party's intellectual-property rights, Gainify — not Apple — is solely responsible for the investigation, defence, settlement and discharge of that claim.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms of agreement when using the app.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these terms and, upon your acceptance, will have the right (and will be deemed to have accepted the right) to enforce these terms against you as a third-party beneficiary.
Shopify apps — additional terms
These terms apply where you install one of our apps on a Shopify store. By installing, you confirm you are authorised to act for the store and you accept these terms on its behalf.
Installing the app grants it the API access scopes shown on the installation screen. You may revoke that access at any time by uninstalling the app. We use that access only to provide the app’s features.
Where an app is paid, charges are created through Shopify’s Billing API and billed by Shopify on your Shopify invoice, subject to Shopify’s billing rules including any free trial shown at install. Uninstalling the app cancels the recurring charge going forward; Shopify’s own refund and proration rules apply, and we do not charge you outside Shopify’s billing system.
You are responsible for the content you publish through our apps on your storefront, for its accuracy, and for complying with the law that applies to it — including advertising, pricing and consumer-protection rules, and any consent or disclosure your own privacy notice requires. You remain the data controller for your customers’ personal data; we act as your processor as described in our Privacy Policy.
We may change, add or remove features, and we may suspend access where required by Shopify, by law, or where an installation harms the service or other merchants. Where a change is material and within our control, we will give reasonable notice.
Your use of Shopify itself is governed by your agreement with Shopify. Shopify is not a party to these terms and is not responsible for our apps.
Acceptable use
You agree not to misuse the apps or site, reverse engineer them except as permitted by law, or use them to break any law or infringe anyone’s rights.
Intellectual property
The apps, this site and their content are owned by Gainify or its licensors and are protected by intellectual-property laws. These terms grant you no rights in our trademarks or branding.
Disclaimers
The apps and site are provided "as is" and "as available" without warranties of any kind, to the maximum extent permitted by law. We do not warrant that they will be uninterrupted, error-free, or fit for a particular purpose.
Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental or consequential damages arising from your use of the apps or site. Nothing in these terms limits liability that cannot be limited under applicable law, including your statutory rights as a consumer.
Governing law
These terms are governed by Spanish law and applicable EU law. Mandatory consumer-protection rules of your country of residence continue to apply.
Changes
We may update these terms; the "Last updated" date shows the current version. Continued use after changes means you accept them.
